ORDINANCE No. 2025- _11____

AN ORDINANCE ADOPTING THE 2026 ZONING ORDINANCE AND A ZONING MAP FOR THE TOWN OF CEDAR BLUFF, ALABAMA, IN ACCORDANCE WITH THE PROVISIONS OF TITLE 11, CHAPTER 52 CODE OF ALABAMA. 1975, AS AMENDED. REPEALING ALL CONFLICTING ORDINANCE AND MAPS; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE.

WHEREAS, Title 11, Chapter 52, Code of Alabama, 1975, as amended, authorizes the Town Council to enact a zoning ordinance to govern all territory within the corporate limits of the Town of Cedar Bluff, Alabama, and

WHEREAS, the Town of Cedar Bluff, Alabama desires to exercise its zoning powers in accordance with Alabama law; and

WHEREAS, the Planning Commission along with East Alabama Regional Planning and Development has prepared a zoning ordinance and zoning map for the Town; and

WHEREAS, the Planning Commission conducted a formal public hearing on the proposed zoning ordinance and map on 06/26/2025 and a committee meeting on 10/21/2025 and made the recommendation to adopt by the Town Council of the aforementioned zoning ordinance and zoning map; and

WHEREAS, the Cedar Bluff Town Council conducted a formal public hearing on December 8, 2025 to receive further public comments on the proposed zoning ordinance and zoning maps in accordance with Section 11-52-77 of the Code of Alabama, 1975, as amended;

NOW THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF CEDAR BLUFF, ALABAMA,

Section 2. That all conflicting ordinances and zoning maps adopted previously by the Town Council, be repealed.

Section 3. That the aforementioned zoning ordinance and zoning map become effective five days from the date of final posting in accordance with Section 1145-8 of the Code of Alabama, 1975, as amended. Adopted, this ____ day of December, 2025.

Section 1. That the Cedar Bluff Town Council hereby adopts the Cedar Bluff Zoning Ordinance and accompanying Zoning map for the Town of Cedar Bluff, Alabama entitled the Zoning Map of Cedar Bluff Alabama, attached hereto and made a part thereof, be adopted pursuant to the authority granted by Title 11, Chapter 52, Code of Alabama, 1975, as amended
