ORDINANCE NO. 2025-6____

AN ORDINANCE OF THE TOWN OF CEDAR BLUFF ADOPTING THE 2018 EDITION OF THE INTERNATIONAL BUILDING CODE; REGULATING AND GOVERNING THE CONSTRUCTION, ALTERATION, MOVEMENT, ENLARGEMENT, REPLACEMENT, REPAIR, EQUIPMENT, USE AND OCCUPANCY, LOCATION, MAINTENANCE, REMOVAL, AND DEMOLITION OF BUILDINGS AND STRUCTURES; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES; AND PROVIDING FOR PENALTIES FOR VIOLATIONS.

SECTION 1. Purpose

The purpose of this ordinance is to protect public health, safety, and general welfare by adopting the 2018 International Building Code, as published by the International Code Council, as the Building Code of the Town of Cedar Bluff.

SECTION 2. Adoption of the 2018 International Building Code

The 2018 International Building Code (IBC) as published by the International Code Council, is hereby adopted and incorporated by reference as though fully set forth herein, subject to the amendments provided in this ordinance.
At least one copy of the 2018 IBC shall be kept on file in the office of the Town Clerk and Building Inspector for public use and inspection.

SECTION 3. Local Amendments

The following amendments are hereby made to the 2018 International Building Code:

1. Section 101.1 Title— Amend to read:
   “These regulations shall be known as the Building Code of the Town of Cedar Bluff.”
2. Permit Fee Schedule— Replace IBC fee schedule with the fee structure adopted by the Town of Cedar Bluff, as set forth in attachment of this ordinance.
3. Other Local Amendments:

• Local zoning references
• Fire-resistance or egress modifications
• Administration or enforcement procedures

SECTION 4. Conflicts

If any provision of this ordinance conflicts with other local ordinances or regulations, the more restrictive provision shall apply.

SECTION 5. Severability

If any section, subsection, sentence, clause, or phrase of this ordinance is deemed unlawful or unconstitutional, such portion shall be deemed severable and shall not affect the validity of the remaining portions.

SECTION 6. Enforcement

The Building Official of the Town of Cedar Bluff, or their designated representative, is authorized and directed to enforce the provisions of the 2018 IBC and this ordinance.

SECTION 7. Penalties

Any person, firm, or corporation violating any provision of the 2018 IBC or this ordinance shall be subject to a penalty of up to 100% of total fee.

SECTION 8. Repeal of Prior Codes

All ordinances or parts of ordinances in conflict with this ordinance, including prior editions of the International Building Code previously adopted by the Town, are hereby repealed.

SECTION 9. Effective Date

This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.
